Tracing Agents and Pre Sue Enquiry Reports
Liverpool Process Servers, advise that the first step in any Court action is to determine the place of residence of the person against whom action is contemplated and we carry out this function in many instances by initially tracing and locating the individual prospective defendant.
In order to protect clients from financial loss, the process server assigned to the enquiry would advise clients that it is paramount that where it is proposed to begin a civil action or civil process to recover either monies owing to him, or indeed to seek damages for some form of injury, that they determine whether the third party against whom they are about to take action has the financial ability to pay both the costs of an action and the amount of compensation being sought from the Court.
If the potential defendant has few assets a client about to embark on litigation could be left to bear the cost of an action and have no means of receiving recompense due to the prospective defendant having no assets. It is therefore essential to establish that the third party has sufficient resources from which costs and compensation can be recouped, otherwise the client could suffer further loss.
Consequently our process server in Liverpool and Merseyside would advise the client to initially carry out a 'Pre Sue' Enquiry to establish the assets of the third party, thus avoiding further unnecessary loss. We have a number of measures available and data bases to interrogate to establish the means of a potential defendant and the likelihood or indeed certainty of a satisfactory Court action.
